Even more harshly corrected in 2008, the right of prosecution for violation of customs control of the Constitutional Court, which ordered the possible use of alternative methods of studying the material evidence (eg photographs), and also forbade the owners refuse to return the property without "informed and reasoned decision" .

However, the FSB refused Mr. Pevsner without explanation, without revealing his motives, even in the courtroom.
