Cultural Property - objects of material and spiritual culture, which have artistic, historical, ethnographic and scientific value and are subject to the preservation, renewal and protection in accordance with the laws of Ukraine, namely:
original art paintings, drawings and sculptures, artistic compositions and installation of any materials, works of decorative crafts and traditional folk art;
objects connected with historical events, the development of state and society, history, science and culture, as well as those that relate to the life and work of eminent state, political parties, public and religious organizations, science, culture and art;
objects of museum value, found during archaeological excavations;
parts and fragments of architectural, historical and artistic monuments and monumental art;
old books and other publications, which are the historical, artistic, scientific and literary value, individually or in collections;
manuscripts and incunabula, staropechati, archival documents, including films, photos and phonodocuments, singly or in collections;
unique and rare musical instruments;
different types of weapons that have artistic, historical, ethnographic and scientific value;
rare stamps and other philately material, individually or in collections;
rare coins, medals, coin, stamp and other collectibles;
zoological collections, which are scientific, cultural, educational, training and educational or aesthetic value;
Rare collections and specimens of flora and fauna, minerals and anatomy, and paleontology;
Family values - cultural values, which have the character of personal or family items;
In accordance with the laws of Ukraine Ukraine's cultural values is:
cultural values created in the territory of Ukraine by citizens of Ukraine;
cultural values created in the territory of Ukraine by foreigners or stateless persons who reside or resided in the territory of Ukraine;
cultural values found on the territory of Ukraine;
imported into the territory of Ukraine's cultural property acquired by archaeological, archaeological, ethnographic, scientific expeditions and other physical scientists with the consent of relevant authorities in the country of origin of those values;
imported into the territory of Ukraine cultural values acquired through voluntary exchange;

Cultural values, which may be returned to Ukraine and from the territory of Ukraine
Return to Ukraine are the following:
cultural property illegally exported from the territory of Ukraine;
cultural values evacuated from the territory of Ukraine during the wars and armed conflicts and not returned back;
cultural values have temporarily removed from the territory of Ukraine and not returned to Ukraine.
Cultural values, which are outside of Ukraine on legal grounds, may be returned by a contract of purchase and sale with the owner of cultural values, sharing them on mutually beneficial terms, or receiving a gift.
Cultural values, which are legally owned by individuals or legal entities in Ukraine, but the origin, which are connected with the history and culture of other countries, may be returned to this state by a contract of purchase and sale with the owner of cultural property, in exchange for mutually agreed terms or receive a gift.
Public agency controls the export and export of cultural property
Specially authorized state body monitoring exports and imports and the return of cultural property is a public service of controlling the movement of cultural property across the state border of Ukraine under the Ministry of Culture and Arts of Ukraine (further - Public service control).
Public service control to perform its mandated tasks and interaction with the Chief Archival Department of Ukraine, the National Commission for the return of cultural property in Ukraine, State Customs Service of Ukraine, the law enforcement agencies.
To coordinate the work of ministries and other central executive authorities on the management and monitoring of exports and imports and the return of cultural property created Interdepartmental happy on the export, import and return of cultural property. Composition of the Interagency happy on the export, import and return of cultural property and the provisions therein shall be approved by the Cabinet of Ministers of Ukraine.
Public Service Monitoring
Public service monitor the movement of cultural property across the state border of Ukraine (further - Public service control) is a governmental body in the control of exports and imports and the return of cultural property, which operates within the Ministry of Culture and obey him.
State control service within its competence:
ensures that public examination of cultural values, presented for export (temporary export), and when returning after a temporary export;
considering a petition of owners of cultural property or their authorized persons;
decide on the possibility of removal (temporary export) cultural values;
issue an export permit (temporary export) cultural values;
shall register the exported (temporarily imported) cultural values;
lists of cultural values, which are exported (temporarily exported), and establishes a regime of temporary export;
inform the public in Ukraine and abroad about the facts of the loss or theft of cultural property;
practical arrangements for the return of stolen, illegally exported and evacuees and the return of cultural property;
develops and carries out activities aimed at fulfilling the international obligations of Ukraine on preventing the illicit import, export and return of cultural property.
Public service has the right to control:
attract executive bodies, enterprises, institutions and organizations (in consultation with their leaders) to address issues that belong to its competence;
involve scientists, specialists and experts to study the problems of export, import and return of cultural property;
controls and conduct audits on issues that belong to its competence;
receive in due course from the executive authorities, local governments, enterprises, institutions and organizations the information needed to implement the provisions of its tasks;
convene in due course of the panel on issues that belong to its competence;
transfer in the prescribed manner to the law enforcement bodies about violations of legislation on the movement of cultural property;
issue orders organizational raporyaditelnogo character, if necessary - together with other executive bodies and local authorities.
In cases specified by law, the decision of the State Service control is binding on the executive authorities, local authorities, institutions, organizations and citizens.
The state examination of cultural values
Presented for export (temporary export) and returned after temporary export of cultural goods are subject to mandatory state examination. Conduct public examination of cultural values and the size of payment for it shall be approved by the Cabinet of Ministers of Ukraine.
Denial of physical or legal person who has violated the applicant's representative (temporary exportation), cultural values, to bring to public examination of cultural values, which are available for export is considered as a waiver of the applicant on their export.
If the result of state examination gives grounds for skidding as submitted to the export of cultural property in the State register of national cultural acquisition, materials expertise is transmitted to a central executive authority, without consent of the person who has violated the petition.
Export certificate (temporary export) cultural values
Public service monitoring at the request of cultural property owner or his designated person shall on the basis of breeding state examination as to the feasibility or the inability to export cultural property. On the decision of cultural property owner or authorized person of a written report within one month from the date of official receipt of the application.
If the State service control solutions on the possibility of removal (temporary export) cultural values of cultural property owner or authorized person certificate is issued a standard form of an export certificate (temporary export) cultural values. Model export certificate (temporary export) of cultural property adopted by the Cabinet of Ministers of Ukraine.
Export certificate (temporary export) cultural values is the basis for moving specified therein cultural values outside the customs territory of Ukraine. Taken out of cultural property without this certificate is prohibited.
Export from Ukraine not to be:
cultural values, listed in the State register of national cultural acquisition;
cultural values included in the National Archives Foundation;
cultural values included in the Museum Fund of Ukraine.
The order of registration of the right to export cultural property
Application of the right to export cultural property shall be presented no later than one month of the date of their removal by the owner or person authorized by the State monitoring service.
The request is added:
document, which confirms the right of ownership of cultural property;

Import of cultural property in Ukraine
Cultural values, which are imported in Ukraine, are subject to registration in the manner prescribed by the Ministry of Culture and Arts of Ukraine, the Chief Archival Department of Ukraine, together with the State Customs Service of Ukraine. During the import of cultural property in the territory of Ukraine the customs authorities presented a certificate of entitlement to export, if the legislation of the State, where imported cultural values. In the absence of such a certificate imported values shall be detained by customs authorities of Ukraine to establish their ownership and obtain his instructions on the subsequent transfer or use of these values. Such orders must be confirmed by a diplomatic mission or consular office of the country, of which he is the owner of cultural property.
The import of cultural values on which the search is declared, is prohibited. Such cultural values should be excluded by customs authorities of Ukraine to return them in the prescribed manner to the owner.
The temporary export of cultural property
The temporary export of cultural property can be natural and legal persons:
for the organization of exhibitions;
for restoration work and research;
a bunch of theater, concert and other artistic activities;
in other cases stipulated by legislation of Ukraine.
Cultural values, temporarily removed from Ukraine and not returned in due time the agreement are considered to be smuggled.
Application for permission for temporary export of cultural property is presented by the owner or person authorized by the State monitoring service.
The request is added:
notarized copy of the agreement with the host about the purpose, guarantee the safe storage and return of cultural property in the agreement stipulated period;
insurance documents cultural values, which are temporarily exported, with the provision of all cases of insurance risk or an instrument of state guarantees cover the financial risk of any, issued by a country which takes cultural values;
document, which confirms the right of ownership of cultural property;
Conclusion of the state examination.
Cultural values, which are temporarily imported to Ukraine are subject to registration in the manner prescribed by the State Control Service with the State Customs Service of Ukraine.
Refusal to issue a certificate for the right of temporary export of cultural property
Certificate for the right of temporary export of cultural property can not be issued if:
відсутні assurances regarding the secure storage and return of cultural property in the agreement stipulated period;
presented for the temporary export of cultural values in such a way that it is impossible to change the conditions of storage;
cultural values are the subject of a dispute over the ownership of them;
insured value of cultural values, presented for the temporary export did not meet their real value;
cultural values, presented for the temporary export, are wanted;
in the State from which envisaged to implement the temporary export of cultural valuables, took a natural disaster, armed conflict arose, the state of emergency or other circumstances exist which impede the safe storage and return of cultural property, which is temporarily exported to that country.
Terms of the agreement regarding the temporary export of cultural property can not be changed after the issuance of a certificate for the right of temporary export of cultural property.
Transit cultural values
Transit of cultural values through the territory of Ukraine is regulated by customs laws and international treaties of Ukraine.
The order of use of seized or confiscated cultural property
Cultural property seized by customs or law enforcement authorities, and confiscated by the court, sent free of charge to the Ministry of Culture and the Arts, the Main Archival Administration of Ukraine, which provide for the keeping, examination and information about them in order to clarify the ownership of them.
After establishing the right of ownership for these cultural values are transmitted in the prescribed manner to its rightful owner or authorized person.
The cost of storage and examination of cultural property to reimburse the owner, unless otherwise stipulated by the legislation of Ukraine or by judicial decision.
If seized or confiscated cultural property return in accordance with the law in state revenue, the Interagency Council on the import, export and return of cultural property to determine whether to bezoplatnoy transfer of cultural property for permanent storage in the state of the museum, library and archive collections, or religious organizations.
In order to avoid the acquisition of illegally exported from other states, or stolen cultural property acquired by unscrupulous individuals and entities regardless of ownership, who wish to acquire the ownership of cultural property are required to take the necessary steps to obtain information on the origin of these cultural values.
Legal and natural persons who carry out commercial activity in cultural property, must keep a register in which shall contain information on the origin of each cultural object, surname, first name, middle name and address of supplier, description of cultural values and its value.
